Any person who has taken an oath of office to support the Constitution of the United States and has violated that oath through insurrection or rebellion against the United States or given aid or comfort to the enemies of the United States, may not become a Senator or Representative in Congress, elector of President or vice President or hold any office, civil or military, under the United States or under any state. 18 USC Sec. 1918. Whoever violates the provision of section 7311 of title 5 that an individual may not accept or hold a position in the Government of the United States or the government of the District of Columbia if he—(1) advocates the overthrow of our constitutional form of government; (2) is a member of an organization that he knows advocates the overthrow of our constitutional form of government.
